ALERT: EB-5 Price Increase Coming

The September 30 grandfathering deadline has passed, but another major EB-5 date is now approaching.

On January 1, 2027, the minimum EB-5 investment amount is scheduled for its first inflation adjustment under the EB-5 Reform and Integrity Act. While the exact new figure has not yet been announced, investors considering the program now have a limited window to file at the current $800,000 minimum.

EB-5 Price Increase Is Coming

The current $800,000 investment level has been in place since 2022, but it was never intended to remain fixed indefinitely.

Beginning January 1, 2027, the minimum investment is scheduled to adjust for inflation. Once the new amount takes effect, investors filing afterward would need to meet the higher threshold.

For families already considering EB-5, this makes the remaining months of 2026 increasingly important.

December Is the Month to File

Although January 1 is the date of the scheduled adjustment, investors should not wait until then to begin preparing.

An EB-5 petition takes time. The investment must be completed, the lawful source and path of funds must be documented, supporting financial records must be collected, and the I-526E petition must undergo legal preparation and review.

For investors using business income, property proceeds, gifts or funds moving across multiple jurisdictions, this process can take several weeks.

That is why December should be treated as the practical filing deadline for investors who want to proceed at the current $800,000 investment amount.

Do Not Wait Until the Final Days

Bank transfers can be delayed. Financial documents can take time to obtain. Additional questions may arise during source of funds review.

Those issues are much easier to resolve when there is still time available.

Investors who leave the process until the final days of December risk entering 2027 before their petition is ready to file.

File Before the Price Increase

There is still time to move forward under the current $800,000 minimum, but the window is getting smaller.

January 1 is when the price adjustment is scheduled to take effect. December is when investors should aim to have their EB-5 filings completed.
