It is important for prospective investors to acquaint themselves with the new EB-5 laws

The U.S. golden visa popularly known as the EB-5 immigrant investor visa requires investors to inject $800,000 into a government approved commercial enterprise for eligibility for U.S. green card and residency for their spouse and children under the age of 21. Since the inception of the program in 1990, the general program structure, offering and benefits have remained unchanged. While competing national migration programs have increased their required capital or changed integral parts of their program, the U.S. continued to facilitate EB-5 applications under the same regulations for almost 3 decades. Over the years the program continued to garner interest and served as a catalyst for economic and labor market growth for the U.S. However, in the last few months the Regional Center program underwent rigorous structural and integral changes that were made to ensure that the program continues to positively impact the investors and the country.

On March 15, 2022, The EB-5 Reform and Integrity Act of 2022 (“RIA”) was enacted and the Regional Center program was revived. The enactment of RIA provided the program with numerous positive changes such as a long program authorization period, grandfathering provisions, concurrent filing or advanced parole, investor integrity fund, regional center accountability checks.
