Priority Date Changes

The new bulletin provides the advancement in priority date processing for investors with priority dates between November 15, 2019, and February 15, 2021. This means that investors who were formally retrogressed can now move forward with their green card applications. 

Advantages of Priority date changes 

This advancement creates immediate opportunities for Indian EB-5 investors who have been on the waiting list. If your priority date falls between November 15, 2019, and February 1, 2021, you now have several pathways forward:

• Adjustment of Status: If you are currently in the United States on a valid visa, you can file Form I-485 to adjust your status to permanent resident without leaving the country.
• Consular Processing: If you are outside the US, you can schedule your immigrant visa interview at a US embassy or consulate.
• Work and Travel Authorization: During processing, you’ll be eligible for employment authorization documents and advance parole for international travel

The October Bulletin’s release coincides with the start of the new fiscal year 2026, bringing along fresh visa allocations and maximum availability. This provides several strategic advantages:

• October, being the first month in the fiscal year, offers the highest visa availability before numbers are consumed throughout the fiscal year
• Processing capacities can accommodate the increased application, although this may not be the case as awareness spreads
