EB-5 QUESTION OF THE WEEK: DOES THE EB-5 PROGRAM HAVE PREVIOUS PROFESSIONAL EXPERIENCE, LANGUAGE SKILLS, OR MINIMUM EDUCATION REQUIREMENTS?

No, the EB-5 Immigrant Investor program does not require investors to have previous professional experience, English language proficiency, or a minimum level of education. The EB-5 program was created by the U.S. Congress in 1990 with the incentive of attracting foreign investors to the U.S. economy in exchange for the U.S. Green Card. While the program does have certain requirements, it is not a point-based system similar to other government immigration programs, and as such, does not have professional experience, educational, or language skill requirements. That said, an applicant’s personal and professional background in the form of supporting documentation including but not limited to resume, degrees and certifications, salary certificates, and bonus letters will be presented to the U.S. immigration office (USCIS). These documents are only provided for the purpose of demonstrating an investor’s source of funds and personal information.

The principal requirements of the program are that the minimum investment of $800,000 be made in a qualifying project with funds that have originated from a lawful source and that this investment be “at risk.” The U.S. golden visa program also requires that a minimum of 10 full-time jobs be created for U.S. persons with the foreign applicant’s investment. Working with an experienced EB-5 advisor is advantageous to EB-5 applicants as an advisor is able to provide guidance on the requirements of the program and simplify the EB-5 immigration process. A knowledgeable EB-5 advisor can be hugely beneficial to families seeking to obtain the U.S. Green Card through investment as the advisor will serve as a single point of contact between the immigration attorney of record, USCIS, and the regional center with which the family invests.
