Immigration landscape is changing on a daily basis in 2020, especially now given the current circumstances in relation to COVID-19. Secure the future of the family by obtaining the U.S. green card and  a stable path for the family.

Shortly after taking office, President Donald Trump signed an executive order barring entry for nationals of certain Muslim-majority countries, claiming that the executive order was required to establish proper vetting systems in order to protect national security. Thereafter in September 2017, the Trump administration announced the end of the Deferred Action for Child Arrivals (“DACA”) program, which had been established by President Obama protecting undocumented immigrants that were brought into the United States as children.

In June 2020, Trump signed a proclamation suspending immigration to the United States, one of the only exceptions to the immigration ban is the EB-5 program whereby investors have the opportunity to gain the U.S. green card through an investment of $900,000 in the U.S. economy. Also recently in late June 2020, Trump signed an executive order barring many people on employment-based visas including the H1-B from entering the U.S. until 2021. In line with his goal of tightening immigration, Trump most recently signed an executive order in July 2020 barring international students from remaining in the United States if their colleges or universities were moving towards offering classes online in the Fall semester due to threats of COVID-19. After facing a tremendous level of backlash due to this hasty and unreasonable decision, Trump rescinded his decision. As evidenced by these and other actions, the Trump administration has shown a disfavorable position towards immigration.

In 2020, this stance and policy is unlikely to change for a number of reasons. Firstly, as unemployment rates continue to maintain their positions across all states above 10%, it fits within Trump’s mantra of closing the door to legal migration and forcing American companies to strictly hire the workforce of Americans currently living in the United States. Secondly, irrespective of employment numbers, some of his voter base appears to be suffering from Xenophobia, which is the fear of what appears foreign or foreign influence upon the American people. Thus, the concept of insulating foreigners from moving to America through simpler migration programs has been favorable for a narrow segment of his voters. Lastly, there has not been many instances of successful restraint on presidential powers lodged by Congress. So far, the executive orders from the Trump Administration on immigration have withstood, and some may say, bolstered his presidential powers, while diminishing, or at least challenging, the legislative and judicial powers of the U.S. government.

Given the general policy of Trump in restricting immigration and the volatile immigration landscape, the most secure path for a family to obtain their U.S. green card is to participate in the EB-5 program. Upon the receival of their U.S. green card and thereafter their citizenship, they will no longer be subject to the unstable immigration policies of this presidency. The EB-5 program remains one of the only exceptions to Trump’s immigration ban. This shows that Trump understands the importance of the EB-5 program for job creation purposes for the U.S. economy. Any individual or family considering a move to the United States should act swiftly in applying for the U.S. green card through the EB-5 program and take advantage of the President’s favoring of this program. A holder of the U.S. green card will be considered as a U.S. person and will be able to benefit from all the advantages that pertain to a U.S. person, including but not limited to educational benefits.
